By using the Service, you represent and warrant that you have the right, authority, and capacity to agree to, and abide by, this Agreement. Service membership is void where prohibited by law.
IMINENT reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.

 ACCOUNT TERMS

1. You must submit a valid, verifiable e-mail address and select a password and user name when registering for the Service. You also agree, as part of the registration process, to provide certain information about you as prompted - this information must be current, complete, and accurate.
2. You must be 13 years or older to use this Service.
3. You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
4. You are responsible for maintaining the security of your account and password.
5. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

 GUARANTEES & LIABILITIES

IMINENT cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You agree to the following conditions regarding any content, or profile information that you publish, post, or display by using any of IMINENT Services:

1. IMINENT may delete any Content that in its sole judgment violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of members.
2. You are solely responsible for the Content that you post or transmit by using the Services.
3. You reserve all rights over your content. You grant to IMINENT a worldwide, non-exclusive, fully paid-up, royalty-free, irrevocable, perpetual, sublicenseable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your Content submissions in connection with the Service and IMINENT (and its successor’s) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.
4. You further agree that you will not: (i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant IMINENT all of the license rights granted herein; (ii) publish falsehoods or misrepresentations that could damage IMINENT or any third party; (iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) post advertisements or solicitations of business: (v) impersonate another person. IMINENT does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and IMINENT expressly disclaims any and all liability in connection with User Submissions. IMINENT does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and reserves the right to remove Content, User Submissions and to close user accounts without prior notice. IMINENT also reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. IMINENT may remove such User Submissions and/or terminate a User’s access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

 COMPUTER SETTINGS

Users’ computer settings, such as, but not limited to, computer’s operating system, browser name, browser versions , may be collected by IMINENT services for the purpose of enhancing User experience with our services. This information will neither contain nor be linked to any personally identifiable information.

 INFORMATION CONCERNING USERS

IMINENT will use certain non-personally identifiable information of Users to create aggregate, non-personal, demographic reports about the Users of the Service.

 COOKIES

“Cookies” are pieces of information that are placed on an individual’s computer hard drive to enable the individual to more easily communicate and interact with the Service and Web Site. IMINENT may use cookies to save certain information about a User and others who visit any IMINENT Web property, in order to facilitate and enhance future activities with the Service and/or Web Site…

IMINENT may send you emails if you chose to Opt-in during the setup process or at other collection points on our website where you clearly stated that you wish to receive such emails.
The nature of emails IMINENT may send you are:

IMINENT SA will not disclose, share, rent or sell to any third parties your email adress except in limited circumstances such as when we believe we are required to do so by law.
IMINENT SA will offer to send an email about IMBooster to your friends via our “Invite Your Friends” feature.  When you invite your friends they will only receive one invitation email from you.  You and your friends will not receive any additional emails from IMINENT or any other third party.
Your email address and you friends email addresses, when we have them stored in our database, are protected by IMinent.
If you wish to remove your email address from our database you can do it by clicking the link at the end of the email you received or by writing to support@iminent.com.

 GENERAL USAGE PATTERNS

IMINENT may gather information related to Users’ use of IMINENT services such as
4. Browser type, IP-address, date and time of access, cookie ID, and referrer URL
5. Instant Messaging usage, data displayed or clicked on (including UI elements, ads, links)
in order to
     „X improve end-user experience
     „X provide those users with relevant informations & service offerings
     „X Deliver relevant advertising and related links based on the IP address, content of messages and other information related to your use of IMBooster & IM software
6. IMinent let after uninstall some tracking assets for reporting issues, and to be able to propose you the appropriate products depending on what you could have installed/uninstalled, for IMinent as for IMinent’s third parties.
We provide advertisers only aggregated non-personal information. We do not sell, rent or otherwise share your personal information with any third parties except in limited circumstances such as when we believe we are required to do so by law.
7. IMinent let after uninstall some log files (in the temporary folder “%temp%\Iminent\Log”) named “IMBooster.msi.log”, “IMinentToolbar.msi.log”, “SearchTheWeb.msi.log”. Those files are created during the installation of our application, to log potential errors that could occur during the installation procedure. Those files are not necessary to use IMinent’s application and services, you can delete them whenever you want.

7. The failure of IMINENT to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and IMINENT and govern your use of the Service, superceding any prior agreements between you and IMINENT (including, but not limited to, any prior versions of the Terms of Service).
8. You agree that according to your configuration, IMINENT may installs some or all of the following third party applications Microsoft .NET Framework (that can be uninstalled by “Windows Installer CleanUp”, cf. http://support.microsoft.com/kb/290301) - Adobe Flash (that can be uninstalled through the following instructions http://kb2.adobe.com/cps/141/tn_14157.html)
9. IMINENT possibly provides you a toolbar for your web browser, if you wish to uninstall it: For Internet Explorer: Go to “Start” → “Settings” → “Control Panel”. On your control panel, select “Programs and Features”. Now select “IMinent Toolbar” from the list of currently installed programs. Click “Uninstall” and follow the instructions (N.B.: the Firefox toolbar is not removed when you uninstall the Toolbar Iminent via Add/Remove Programs). For FireFox: You can hide the IMINENT Toolbar for Firefox by clicking your right mouse button while the cursor is over the IMINENT toolbar, and then selecting IMinent Toolbar. If you prefer to uninstall the IMINENT for Firefox and remove it from your computer entirely, go to your Tools in Firefox menu and select Add-ons. Now select IMinent Toolbar for Firefox and click on Uninstall button.
